Limited Warranty

Modgav warrants that your product is free from defects in materials and workmanship. That covers the structural integrity of the machined aluminum, including cracking, deformation, loosening, and structural failure under normal use. It covers the Mod-Rail channels and how parts seat in them. It covers the threaded hardware, inserts, and feet. And it covers defects in the anodized finish that were present when your product arrived, such as blistering, delamination, adhesion failure, or uneven coating.

Four years on the Plank, in every size.

One year on Mod-Rail accessories. The accessories are where the hinges, drawer slides, and rotating joints are, and moving parts wear in a way solid aluminum does not. We would rather give you an honest number on those than a round one we have to argue about later.

One year on pads, grips, liners, and adhesive backed parts. After that we will sell you replacements at our cost.

Register your product within 90 days of delivery and we add a year. Four becomes five on the Plank and one becomes two on the accessories. Pads, grips, and liners stay at one year.

Every term starts the day your product is delivered to you.

Within your accessory coverage, a joint that will no longer hold its position under the load it is rated for is a defect and we will replace the part. A drawer slide that binds, seizes, or separates is a defect and we will replace it. What is not a defect is a gradual change in how a joint feels. Friction shifts with use. That is a mechanism working, not a mechanism failing.

This warranty covers the original purchaser. It applies to products bought or received directly from Modgav, or bought from an authorized Modgav retailer. It does not cover products bought secondhand or from an unauthorized seller.

• Normal wear. Aluminum shows the marks of use. Scratches, scuffs, abrasion, patina, and gradual changes in color, tone, or sheen are what an anodized surface does over years on a working desk, and sustained exposure to sunlight will lighten any anodized finish over time. It is not a defect and it is not covered.
• Gradual change in the feel or friction of a hinge, slide, or rotating joint. Mechanisms loosen with use.
• Loading a product beyond its rated capacity. Every Plank and every accessory has a published weight rating.
• Drops, impacts, and accidents.
• Assembly or installation that does not follow the instructions supplied with the product.
• Use outside the home and the office. These products are not rated for outdoor installations.
• Cutting, drilling, refinishing, or otherwise altering a part. Reconfiguring your Mod-Rail accessories is expected and will never affect your coverage. Changing the parts themselves will.
• Use outdoors, or in high humidity, high salt, or corrosive environments. These are indoor desk products.
• Harsh chemicals, solvents, abrasive cleaners, and prolonged direct sunlight.
• Damage that a product made by another company causes to your Modgav product.
• Fire, flood, earthquake, storms, and other events outside anyone's control.
• Products bought secondhand or from an unauthorized seller.
• The cost of clearing and resetting your desk, and any indirect loss.

Mod-Rail is dimensioned around the Modgav accessory line. Those are the parts we test, and fit and load are guaranteed for those parts. If you fit something else to the rail, that on its own does not void this warranty. What we cannot do is promise that a part we did not make will seat correctly or hold what you put on it, or cover damage that another company's product causes to yours.

Some Modgav products hold gear you supply yourself. The Mod-Rail Wireless Charger Stand, for example, holds your own charger. We warrant the stand. We do not warrant your charger, your phone, your monitor, or anything else you set on or in a Modgav product, and we are not responsible for damage to them.

We will repair your product or replace it with the same product, at our option. If that exact product is no longer available, we will replace it with a comparable Modgav product or refund what you paid, at our option. A repair or a replacement does not restart or extend your coverage.

For approved claims shipped inside the United States, we pay freight in both directions. For smaller parts we will often just send the replacement and tell you to keep the original, because shipping a clip across the country twice helps nobody. If we do need something back, we send you a prepaid label. For approved claims outside the United States, we pay to send the repaired or replacement product to you, and any duties, taxes, or import fees are yours.

Write to metal@modgav.com. Send your order number or a dated sales receipt, a description of the problem, and clear photographs of it. If you bought from a retailer instead of from us, that retailer's dated receipt is your proof of purchase. We answer within two business days. Do not ship anything back until we have given you a return authorization.

Freight damage is not a manufacturing defect, but we treat it the same way and we would rather hear about it early. Tell us within 30 days of delivery and send photographs of the packaging as well as the product, and we will replace it. Keep the box until we have sorted it out.

Registration is optional and your coverage is active whether you register or not. We will never ask you to register before honoring a claim. What registering does is add a year, and it means we can pull up your order the moment you write to us. Register within 90 days of delivery at modgav.com/register.

Any implied warranty, including any implied warranty of merchantability or fitness for a particular purpose, is limited to the duration of this written warranty. Modgav is not liable for incidental or consequential damages. Some states do not allow limitations on how long an implied warranty lasts, or the exclusion or limitation of incidental or consequential damages, so those limitations may not apply to you. This warranty gives you specific legal rights, and you may also have other rights which vary from state to state.

This warranty is a commercial guarantee we give you voluntarily, in addition to your rights under the law. You are entitled by law to remedies from the seller free of charge if the goods do not conform to the contract, and this warranty does not affect those rights.
